PRODUCT WARRANTY POLICY

  1. INTRODUCTION

This Product Warranty Policy (the “سياسة الضمان” or “Policy“) sets out the terms and conditions under which Bidoki Global for Water Technologies and Trading W.L.L. (referred to as “Company,” “we,” “us,” or “our“) provides warranty coverage for products purchased by customers (referred to as “you,” “your,” or “Customer“) through our website www.bidokiglobal.com, its sub-domains, mobile application, or any other sales channels operated by us (collectively, the “Platform“).

This Warranty Policy is designed to comply with:

  • Qatar Law No. (8) of 2008 – Consumer Protection Law (as amended)
  • Qatar Law No. (16) of 2010 – Electronic Commerce and Transactions Law
  • Qatar Law No. (11) of 2015 – Commercial Companies Law
  • GCC common consumer protection principles
  • International best practices for product warranties
  • Applicable consumer protection laws in the country of sale

By purchasing our Products, you acknowledge that you have read, understood, and agree to be bound by this Warranty Policy. If you do not agree with any part of this Policy, you must not purchase or use our Products.

  1. DEFINITIONS AND INTERPRETATION

In this Policy, the following terms shall have the meanings set out below:

Term Definition
“AWG” Atmospheric Water Generator, a device that extracts water from ambient air.
“Company” Bidoki Global for Water Technologies and Trading W.L.L. (CR No. 245769), a limited liability company duly incorporated under the laws of the State of Qatar.
“Customer” Any person or entity that purchases Products from the Company.
“Delivery Date” The date on which the Product is delivered to the Customer’s designated address.
“Defect” Any manufacturing defect in material or workmanship that causes the Product to fail to perform in accordance with its specifications.
“Installation Date” The date on which the Product is successfully installed by the Company or its authorized representative.
“Personal Water Spring” The AWG machine manufactured, personalized, and configured specifically for the Customer’s installation address.
“Products” All goods, devices, equipment, accessories, and services offered for sale on the Platform.
“Service Center” The authorized service center designated by the Company for warranty repairs, which shall be located in the country of sale.
“Warranty Period” The period during which the Product is covered by this Warranty Policy.
“Warranty Claim” A claim made by the Customer under this Warranty Policy.
  1. WARRANTY COVERAGE

3.1 General Product Warranty

Subject to the terms, conditions, and exclusions set forth in this Policy, the Company warrants that all electronic devices and water purification equipment sold on the Platform shall be free from manufacturing defects in material and workmanship for a period of one (1) year from the commencement date specified in Section 3.2 below.

3.2 Commencement of Warranty Period

The Warranty Period shall commence on the Delivery Date and shall continue for one (1) year thereafter.

IMPORTANT: The Warranty Period shall commence on the date of successful installation. However, if the installation is delayed or postponed due to factors within the Customer’s control (e.g., site unreadiness, non-compliant electrical outlets, or refusal of entry), the Warranty Period shall automatically commence 14 calendar days following the Delivery Date.

3.3 Scope of Coverage

In the event of a proven manufacturing defect, remedies shall be administered in full compliance with Article 5 of Qatar Law No. 8 of 2008, providing the option of repair, replacement, or refund in consultation with the consumer’s statutory rights, subject to technical verification of the defect by an authorized Service Center.

3.4 What is Covered

This Warranty covers:

(a) Manufacturing defects in material and workmanship;

(b) Components that fail due to defects existing at the time of manufacture;

(c) Any other defects that are proven to have existed at the time of delivery.

  1. INSTALLATION

4.1 Installation During Delivery

The Company shall make reasonable efforts to install the Personal Water Spring AWG machine during the delivery process, subject to the installation site meeting the requirements set forth in the Terms of Sale.

4.2 Postponed Installation

If the installation is postponed for any reason, including but not limited to:

  • The Customer not being ready for installation;
  • The electrical connection not being available or compliant with safety requirements;
  • The indoor installation site not being suitable or compliant with building and safety regulations;
  • The Customer’s failure to provide necessary access or information;

Then the Customer shall be responsible for scheduling a new installation date with the Company. The Customer must follow the installation process as communicated by the Company.

4.3 Additional Charges for Reinstallation

If the Company is required to make a second or subsequent visit to install the Product due to the Customer’s failure to ensure the installation site is ready, the Company shall be entitled to charge the Customer reasonable additional fees for such reinstallation.

4.4 Indoor Use Only

The Personal Water Spring AWG machine is designed and manufactured exclusively for indoor use. If the Customer installs or uses the machine in an outdoor environment, or in any location that is not fully enclosed and protected from the elements:

  • The warranty shall be immediately and permanently void;
  • The Company shall have no obligation to repair, replace, or refund the Product;
  • The Company shall not be liable for any damages, losses, or injuries arising from such outdoor use.
  1. WATER QUALITY TESTING

5.1 Initial Water Quality Testing

The Company shall conduct an initial water quality test upon installation of the Personal Water Spring AWG machine. This initial test is included in the purchase price of the AWG and shall be performed within the first week following installation.

5.2 Periodic Water Quality Testing Schedule

The Customer is required to conduct water quality testing at the following intervals:

5.3 Notification Process for Periodic Testing

The Company shall send a notification to the Customer via the following means at least fourteen (14) calendar days prior to the scheduled testing date:

  • Email (to the Customer’s registered email address);
  • WhatsApp (to the Customer’s registered phone number);
  • Platform Notification (through the Customer’s account on the Platform).

The notification shall include:

(a) The scheduled testing date;

(b) The testing fee and payment instructions;

(c) Instructions on how to proceed with the testing process;

(d) The deadline for payment, which shall be at least seven (7) calendar days before the scheduled testing date.

5.4 Procedure for Periodic Testing

To initiate the periodic water quality testing process, the Customer must:

(a) Receive the Company’s notification for the scheduled test;

(b) Make payment for the testing fee within the deadline specified in the notification;

(c) Upon receipt of payment, the Company shall arrange for the water quality testing to be conducted by an accredited laboratory;

(d) The Company shall share the test results with the Customer upon completion.

The Customer may not independently arrange for testing by a third-party laboratory unless specifically authorized by the Company in writing.

5.5 Failure to Pay for Periodic Testing

IMPORTANT: WARRANTY CONDITION PRECEDENT

The Customer’s payment for and compliance with periodic water quality testing at the required intervals is a condition precedent to the validity and continuation of this Warranty.

  • “Failure to conduct the mandatory 6-month periodic water quality testing will immediately void all company liabilities, warranties, and indemnifications regarding water safety, water purity, and filtration-loop components. It will not alter the structural warranty on unrelated manufacturing defects (e.g., compressor or electronic defects), provided such defects were not caused by fluid stagnation or lack of maintenance.”.

5.6 Disclaimer of Water Quality Liability

The Company shall not be liable for any issues relating to the quality of water produced by the AWG, including but not limited to health concerns, safety issues, or performance degradation, if the Customer has failed to follow the required water quality testing.

  1. WARRANTY SERVICE CENTERS

6.1 Local Service Centers

For customers located outside the State of Qatar, the Company shall designate an authorized service center in the country of sale. The service center shall be responsible for:

  • Receiving and processing warranty claims;
  • Conducting inspections and repairs;
  • Managing warranty replacements;
  • Providing customer support for warranty-related issues.

6.2 Service Center Information

The Customer shall be provided with the contact details and address of the authorized service center in the country of sale at the time of purchase. The Company may update the service center information from time to time and shall notify Customers of any changes.

6.3 Warranty Repairs Outside Qatar

For Products sold outside Qatar:

  • Warranty repairs shall be conducted at the authorized service center in the country of sale;
  • The Customer is not required to return the Product to Qatar for warranty service;
  • The Company shall coordinate with the local service center to ensure warranty coverage is provided in accordance with this Policy.
  1. WARRANTY EXCLUSIONS

This Warranty shall not apply to, and the Company shall not be liable for, any of the following:

7.1 Misuse and Improper Handling

  • Damage caused by misuse, abuse, negligence, or improper handling of the Product;
  • Damage caused by using the Product in a manner inconsistent with the manufacturer’s instructions or specifications;
  • Damage caused by operating the Product outside its intended purpose or specifications;
  • Damage caused by unauthorized modifications, alterations, or repairs;
  • Damage caused by failure to follow safety instructions or warning labels.

7.2 Electrical and Power Issues

  • Damage caused by electrical shocks, power surges, voltage fluctuations, or improper electrical supply;
  • Damage caused by failure to install appropriate safety fuses, circuit breakers, or grounding as required by local electrical safety regulations;
  • Damage caused by improper electrical connections or wiring;
  • Damage caused by power outages, brownouts, or other electrical supply issues.

7.3 Improper Installation

  • Damage caused by improper installation of the Product (unless installed by the Company or an authorized representative);
  • Damage caused by installation that does not comply with the manufacturer’s specifications or local building and safety regulations;
  • Damage resulting from the Customer’s failure to ensure that the installation site meets the required specifications;
  • Damage resulting from installation in an unsuitable or non-compliant location.

7.4 Outdoor Use (Personal Water Spring AWG)

The Personal Water Spring AWG machine is designed exclusively for indoor use. The warranty shall be void if the machine is:

  • Installed or used outdoors;
  • Installed or used in a location that is not fully enclosed and protected from the elements;
  • Exposed to rain, direct sunlight, extreme temperatures, or other environmental conditions outside the specified operating range.

7.5 Consumable Parts

  • Consumable parts, including but not limited to filters, membranes, CO₂ cylinders, batteries, bulbs, and other components that are designed to be replaced periodically;
  • Damage caused by the failure to replace consumable parts in accordance with the manufacturer’s recommended schedule.

7.6 Environmental Factors

  • Damage caused by environmental factors, including but not limited to extreme temperatures, humidity, dust, water damage, fire, natural disasters, or acts of God;
  • Damage caused by exposure to corrosive substances or chemicals;
  • Damage caused by the quality of ambient air (for AWG products).

7.7 Normal Wear and Tear

  • Normal wear and tear resulting from ordinary use of the Product;
  • Cosmetic damage, including but not limited to scratches, dents, discoloration, or fading;
  • Gradual degradation of performance that occurs as a result of normal use.

7.8 Accidents and External Causes

  • Damage caused by accidents, liquid spills, or external impacts;
  • Damage caused by transportation or shipping after delivery;
  • Damage caused by unauthorized repair or attempted repair by third parties;
  • Damage caused by moving the Product after installation.

7.9 Failure to Conduct Required Water Testing

  • Damage or failures relating to water safety, water purity, or filtration-loop components arising from a failure to conduct required water testing.
  • The Company shall not be liable for any issues arising from the Customer’s failure to maintain the required testing schedule.

7.10 CO₂ Products – Liability Transfer

(a) Gas Quality: The Company does not manufacture, fill, or refill CO₂ gas cylinders or capsules. All CO₂ gas refilling services are provided by licensed third-party refilling companies in the country of sale.

(b) Transfer of Liability: To the fullest extent permitted by law:

  • All liabilities relating to gas purity, quality, fitness for consumption, and safety of the CO₂ capsules are passed to and shall be borne exclusively by the licensed refilling company responsible for filling the capsules;
  • The Company shall not be liable for any issues relating to gas quality, purity, safety, or fitness for consumption;
  • Any claims arising from or relating to CO₂ gas quality, capsule safety, or related incidents shall be directed to the refilling company.

(c) Partner Audits: The Company shall conduct periodic audits of its refilling partners to ensure compliance with applicable safety and quality standards. However:

  • Such audits do not constitute an assumption of liability by the Company;
  • The Company does not guarantee, warrant, or represent the quality of gas provided by refilling partners;
  • The Company shall not be liable for any failure of the refilling partner to meet quality or safety standards.

(d) Independent Contracts: The relationship between the Company and its refilling partners is governed by separate, independent contracts. The Customer acknowledges and agrees that:

  • The Customer’s rights and remedies with respect to CO₂ gas quality and capsule safety shall be against the refilling partner, not the Company;
  • The Company acts merely as a facilitator in connecting Customers with licensed refilling partners;
  • The Company shall not be a party to any dispute between the Customer and the refilling partner, except to the extent required by applicable law.

(e) Customer Obligations: The Customer must:

  • Read and follow all safety labels and danger markings on CO₂ cylinders and capsules;
  • Handle CO₂ cylinders with care and in accordance with safety instructions;
  • Store CO₂ cylinders in a well-ventilated area, away from heat sources, direct sunlight, and flammable materials;
  • Not tamper with, modify, or refill CO₂ cylinders without proper training and authorization;
  • Inspect cylinders for damage before use and immediately cease use if damage is detected.

(f) Accidents and Explosions: The Company shall not be liable for any accident arising from CO₂ cylinder explosion or similar incidents if:

  • The Customer has not followed the labels and danger markings written on the cylinders and capsules; or
  • The incident is caused by the negligence or failure of the refilling partner; or
  • The incident is caused by the Customer’s misuse, mishandling, or failure to comply with safety instructions.

7.11 Third-Party Components

  • Components manufactured by third parties that are not covered by the Company’s warranty;
  • The Customer must direct claims for third-party components to the respective manufacturer.
  1. WARRANTY CLAIM PROCESS

8.1 How to Make a Warranty Claim

To make a Warranty Claim, the Customer must:

(a) Contact Us: Notify the Company within a reasonable time after discovering the defect, and in any event prior to the expiry of the Warranty Period;

(b) Provide Proof of Purchase: Submit the original invoice, receipt, or order confirmation as proof of purchase;

(c) Describe the Issue: Provide a clear description of the defect, including when and how it was discovered;

(d) Provide Evidence: Provide photographs, videos, or other evidence reasonably requested by the Company to assess the claim;

(e) Cooperate with Assessment: Cooperate with the Company’s assessment and inspection process, including allowing the Company or its authorized representative to inspect the Product.

8.3 Assessment and Verification

Upon receipt of a Warranty Claim, the Company shall:

(a) Acknowledge receipt of the claim within seven (7) business days;

(b) Assess the claim and, if necessary, request additional information or evidence from the Customer;

(c) Arrange for inspection of the Product, either in person or by requiring the Customer to return the Product to the Company’s designated service center;

(d) Determine, in its sole discretion, whether the defect is covered by this Warranty.

8.4 Claim Decision

The Company shall notify the Customer of its decision within thirty (30) days of receiving the complete claim and all required documentation. The Company may, at its sole discretion:

(a) Approve the claim and proceed with repair, replacement, or refund;

(b) Partially Approve the claim, covering only certain components or aspects of the defect;

(c) Deny the claim if the defect is not covered by this Warranty.

  1. REMEDIES

Subject to technical verification of a manufacturing defect by an authorized Service Center, and in accordance with the consumer’s statutory rights under Article 5 of Qatar Law No. 8 of 2008, the following remedies shall be applicable:

9.1 Repair

If the Company approves a Warranty Claim, it shall repair the Product at its own cost. The Company shall use reasonable efforts to complete the repair within a reasonable timeframe. The repaired Product shall be warranted for the remainder of the original Warranty Period or for thirty (30) days from the date of repair, whichever is longer.

9.2 Replacement

If the Company determines that repair is not commercially practicable, it may replace the defective Product with a new or refurbished Product of equivalent specifications. The replacement Product shall be warranted for the remainder of the original Warranty Period or for thirty (30) days from the date of replacement, whichever is longer.

9.3 Refund

If the Company determines that neither repair nor replacement is commercially practicable, it may refund the purchase price of the defective Product. The refund shall be made using the same payment method used for the original purchase.

9.4 Shipping Costs

9.5 CO₂ Products – No Warranty

The Company does not provide any warranty, express or implied, for CO₂ gas products, including but not limited to CO₂ capsules, cylinders, or any gas refilling services. The Customer’s sole recourse for any issues relating to CO₂ products shall be against the licensed refilling company.

  1. LIMITATION OF LIABILITY

10.1 Exclusion of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, BUSINESS, OR GOODWILL;
  • LOSS OF DATA OR USE OF PRODUCTS;
  • ANY DAMAGES ARISING FROM OR RELATED TO THE QUALITY OF WATER PRODUCED BY THE PERSONAL WATER SPRING AWG;
  • ANY DAMAGES ARISING FROM OR RELATED TO CO₂ CYLINDER EXPLOSION OR GAS QUALITY ISSUES, INCLUDING BUT NOT LIMITED TO GAS PURITY, SAFETY, OR FITNESS FOR CONSUMPTION;
  • ANY DAMAGES ARISING FROM ELECTRICAL SHOCKS OR SAFETY INCIDENTS AT THE CUSTOMER’S INSTALLATION SITE;
  • ANY DAMAGES ARISING FROM OUTDOOR USE OF THE PERSONAL WATER SPRING AWG;
  • ANY DAMAGES ARISING FROM THE CUSTOMER’S FAILURE TO CONDUCT REQUIRED WATER QUALITY TESTING.

10.2 Cap on Liability

THE COMPANY’S TOTAL LIABILITY TO THE CUSTOMER FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS WARRANTY POLICY OR THE PRODUCTS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

10.3 Consumer Rights

Nothing in this Section 10 shall limit or exclude the Company’s liability for:

  • Death or personal injury caused by the Company’s negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability that cannot be excluded or limited under applicable consumer protection laws in the Customer’s jurisdiction.
  1. DISCLAIMER OF IMPLIED WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY PROVIDED IN THIS WARRANTY POLICY.

  1. WARRANTY VS. RETURN

Please note that this Warranty Policy addresses manufacturing defects.

For change-of-mind returns or cancellations, please refer to the Cancellation and Return Policy, which is incorporated by reference into this Policy.

  1. CONSUMER COMPLAINTS

If you have a complaint regarding your Warranty Claim:

  1. Contact us directly – We will respond within Seven (7) business days.
  2. Escalate to the Ministry of Commerce and Industry – If we are unable to resolve your complaint, you may file a complaint through the MoCI Qatar app, available on the Google Play Store and Apple App Store.
  3. Mediation or Arbitration – If the complaint remains unresolved, you may pursue mediation through the Ministry of Justice or arbitration in accordance with the Dispute Resolution Policy.
  1. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 Governing Law

This Warranty Policy is governed by and construed in accordance with the laws of the State of Qatar, including:

  • Law No. (8) of 2008 – Consumer Protection Law (as amended);
  • Law No. (16) of 2010 – Electronic Commerce and Transactions Law;
  • Law No. (11) of 2015 – Commercial Companies Law.

14.2 Jurisdiction

Any legal action or proceeding arising under this Policy shall be brought exclusively in the courts of Doha, Qatar, subject to the mandatory consumer protection rights of the Customer’s jurisdiction to the extent such rights cannot be excluded by contract.

14.3 International Application

For Customers outside Qatar:

  • This Policy shall be interpreted in accordance with Qatari law, subject to mandatory consumer protection laws in the Customer’s jurisdiction;
  • The Company shall comply with applicable consumer protection laws in the Customer’s jurisdiction, provided that such laws do not conflict with Qatari law or impose obligations that are commercially unreasonable;
  • The Company shall provide warranty service through authorized local service centers as set forth in Section 6.

14.4 Language – Qatar

For Customers within the State of Qatar:
In the event of a formal dispute brought before the competent regulatory authorities or courts in the State of Qatar, the Arabic text of this Warranty Policy shall prevail in accordance with local legal proceedings.

14.5 Language – International

For Customers residing outside the State of Qatar:
In the event of any conflict between the English version of this Warranty Policy and any translation, the English version shall prevail to the fullest extent permitted by law.

14.6 Dispute Resolution

Any dispute arising out of or relating to this Warranty Policy shall be resolved in accordance with the Dispute Resolution Policy, which is incorporated by reference into this Policy.

  1. RELATIONSHIP TO OTHER POLICIES

This Warranty Policy is incorporated by reference into the following documents:

  • Cancellation and Return Policy

In the event of any conflict between this Warranty Policy and any other policy, the specific provision of the relevant policy shall prevail with respect to its subject matter.

  1. CHANGES TO THIS WARRANTY POLICY

The Company reserves the right to update this Warranty Policy at any time to reflect changes in legal requirements, business practices, or regulatory guidance.

When changes are made:

  1. We will revise the “Last Updated” date at the top of this Policy;
  2. We will notify Customers of material changes via email or Platform notification;
  3. We will publish the updated Policy on the Platform.

Your continued use of our Platform or purchase of our Products following the posting of changes constitutes your acceptance of such changes.

  1. ACKNOWLEDGMENT

BY PURCHASING OUR PRODUCTS, YOU ACKNOWLEDGE THAT:

  1. You have read, understood, and agree to be bound by this Warranty Policy;
  2. You understand that the warranty coverage is limited to manufacturing defects;
  3. You understand that the warranty period commences on the Delivery Date, but no later than fourteen (14) days after delivery;
  4. You understand that the warranty is void if you use the Personal Water Spring AWG machine outdoors;
  5. You understand that you are required to pay for and conduct periodic water quality testing at 6-month intervals;
  6. You understand that the warranty is void immediately regarding water safety and filtration-loop components if you fail to pay for and follow the required periodic testing, while the structural warranty for unrelated machine components remains intact until the end of the Warranty Period;
  7. You understand that the Company will send notifications for scheduled testing, but the responsibility to ensure testing is completed remains yours;
  8. You understand that installation fees may apply if a second visit is required for installation;
  9. You understand that warranty service shall be provided through authorized local service centers in the country of sale;
  10. You understand that the Company is not liable for CO₂ gas quality or safety, and all such liabilities are transferred to the licensed refilling partner;
  11. You understand the exclusions and limitations of liability set forth in this Policy;
  12. You understand that this Policy does not deprive you of mandatory consumer protection rights under the laws of your jurisdiction;
  13. You understand that the Arabic text shall prevail for Customers in Qatar, and the English text shall prevail for Customers outside Qatar.
